Hilda has over 30 years’ experience in conducting arbitrations, mediations and workplace facilitations, as well as in the chairing of disciplinary enquiries and appeal hearings. She presided in the Industrial Court from 1990 – 1999 and is currently an accredited arbitrator (Association of Arbitrators) and senior commissioner at the CCMA and various bargaining councils.

The full bench of the Western Cape High court recently delivered judgment in a favour of a taxpayer (Cloete J dissenting) who, according to the Tax Court, was simply abusing process. Indeed, when studying the judgment of the Tax Court, it is difficult to see how the taxpayer’s approach was nothing more than an abuse of process which in turn begs the question – why was the taxpayer successful on appeal to the full bench of the High Court?

An enduring myth in our society is that our law recognises the concept of a “common law marriage”, there are some limited statutory protections for life partners, but a cohabitation agreement is necessary, as is a will, to remove any doubt - in death and dispute.
